1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fish Audio ("we," "our," or "us"), governing your access to and use of the Fish Audio mobile application, websites, and associated services (collectively, the "Service").
By downloading, installing, accessing, or using Fish Audio, you signify that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
2. Eligibility & Device Association
You must be at least 13 years of age (or 16 in the European Economic Area) to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have received permission from your parent or legal guardian to use the Service.
The Service utilizes your unique Device Identifier (Device ID) and operating system credentials to authenticate your account and active in-app purchases. You are responsible for ensuring the security of your device and all actions taken through your instance of the application.
3. Voice Cloning, User Content & Third-Party AI Processing
Fish App allows users to synthesize speech, input text scripts, record voice audio, and create custom cloned voice models.
User Consent for Third-Party AI Model Processing
By choosing to utilize the Voice Cloning or Text-to-Speech features, you acknowledge, agree, and consent that your voice recordings, uploaded audio files, and script inputs will be securely transmitted to and processed by third-party artificial intelligence model providers and cloud inference infrastructure to extract acoustic features, train neural voice models, and synthesize speech.
Your Discretion and Warranties:
- Voluntary Decision: The decision to use the Voice Cloning feature is entirely voluntary. You have full discretion to choose whether to participate and whether to submit audio files for third-party AI processing.
- Ownership & Rights Representation: You represent and warrant that you own all rights, title, and interest in any voice recordings or audio files you upload, or that you have obtained express, informed, written consent and authorization from the individual whose voice is being recorded or cloned.
- No Non-Consensual Cloning: You are strictly prohibited from recording, uploading, or cloning the voice of any third party without their explicit consent.
- Commercial & Personal Rights: You retain ownership of the original audio recordings you submit and the resulting speech output generated through your lawful use of the Service, subject to compliance with these Terms.
4. Prohibited Uses & Acceptable Use Policy
You agree not to use the Service, directly or indirectly, for any unlawful, harmful, or fraudulent purpose. Specifically, you agree not to:
- Create malicious deepfakes, deceptive audio, or impersonate real persons, celebrities, politicians, or organizations without authorization for misleading, fraudulent, or defamatory purposes.
- Generate, distribute, or promote hate speech, harassment, threats, defamation, obscenity, or sexually explicit content.
- Defraud, scam, or deceive any person, financial institution, automated verification system, or voice biometrics security system.
- Infringe upon the intellectual property, copyright, trademark, privacy, or publicity rights of any third party.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code, weights, or algorithms of the Service or its underlying AI models.
- Use automated scripts, bots, or scrapers to access the Service or exceed credit limits.
We reserve the right to immediately terminate access, revoke licenses, and delete voice models for any user found violating this Acceptable Use Policy.
5. Subscriptions, In-App Purchases & Billing
Fish App may offer free access tiers, pay-as-you-go credit packs, and auto-renewable subscription plans ("Pro Subscriptions") offering enhanced voice synthesis limits and custom cloning features.
- Billing & Processing: All in-app purchases and subscriptions are processed exclusively through the Apple App Store or Google Play Store. Your purchase will be charged to your Apple ID or Google Play account upon confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
- Managing & Cancelling Subscriptions: You may manage or cancel your subscription at any time through your device's Apple ID or Google Play Account Settings. Cancelling will maintain your subscription access until the conclusion of the active billing cycle.
- Refunds: All purchases are subject to the refund policies of Apple or Google. We do not directly issue refunds for transactions completed through the App Store or Google Play.
6. Intellectual Property & Service Ownership
The Service, including its interface, design, software, algorithms, trademarks, graphics, and pre-packaged voice libraries, is the exclusive intellectual property of Fish App and its licensors. Except for the limited license granted herein, no rights or licenses are granted to you by implication or otherwise.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
Artificial intelligence and neural speech synthesis are evolving technologies. We do not warrant that synthesized audio will be completely free of acoustic imperfections, errors, or delays.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FISH APP, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to defend, indemnify, and hold harmless Fish App, its officers, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your submitted audio content, violation of third-party rights, or breach of these Terms.
10. Modifications to Terms
We reserve the right to revise or modify these Terms at any time. If a revision is material, we will provide updated notice on this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration or competent courts.
